General Terms and Conditions of Sale

§1 – Scope and Definitions

These Terms and Conditions (hereinafter referred to as “Terms”) apply to all orders placed through the online shop of Ateliers Schmid Kilic Sàrl, 1700 Fribourg, Switzerland (hereinafter “the Seller”, “we”, “us”). Our online store primarily serves customers with billing and delivery addresses in Switzerland or Liechtenstein. However, international delivery is available. Please refer to §3 and §4 for conditions applying to foreign orders. Any deviating terms and conditions submitted by the Customer will not be accepted unless explicitly approved in writing by the Seller.

§2 – Order Process and Contract Formation

Products can be selected and placed in the shopping cart. Clicking the “Buy Now” button constitutes a binding offer to purchase. The maximum order value per person is CHF 1’500. An automatic confirmation email will be sent upon order placement. This is not a binding confirmation of acceptance. The contract is concluded when we confirm the order by email within 10 working days. If your order contains multiple items, only those confirmed in the acceptance email are part of the contract. If payment is made before acceptance and the order is not confirmed, the amount will be refunded immediately. Contracts are concluded in English. All order details and terms are stored and sent by email in compliance with data protection laws. The customer is required to complete the order form truthfully and in full.

§3 – Delivery

Delivery is made to the address specified by the Customer. Estimated delivery times are shown during checkout. Please allow up to 5 working days of variation. For international deliveries (outside Switzerland and Liechtenstein), shipping fees are calculated at checkout based on destination and weight. Customs duties, VAT or other import fees may be charged upon arrival by local authorities. These are the responsibility of the customer. For in-store pickup, customers have a period of 30 calendar days to collect their order. After this period, the order is considered cancelled and non-refundable.

§4 – Prices and Shipping

All prices are in Swiss francs (CHF) and include VAT. We reserve the right to correct pricing errors. If the correct price is higher, we will contact you for approval. If it’s lower, the lower price applies. Shipping is free from 99 CHF. For orders under 99 CHF, shipping costs range from CHF 3 to CHF 8.90, via Swiss Post. For orders over 99 CHF, a return label and return form are included. Products must be unused and returned in original packaging. Sale items are non-refundable, but may be exchanged for store credit with no expiry. International orders are shipped with tracking and may require a signature upon delivery. In the event of a return from outside Switzerland, the return shipping costs are the responsibility of the customer. If a replacement is required, new shipping fees will be charged. Waldstätten is not responsible for any customs delays or additional charges incurred during international shipping.

§5 – Payment

Only the payment methods shown at checkout are accepted. We may limit payment options on a case-by-case basis. For card payments, your card will be charged upon shipping. Refunds will be issued via the original payment method. If payment is late, a default interest of 8% applies after the due date. Reminder fees of up to CHF 30 may also apply.

§6 – Invoicing

Invoices are sent electronically as PDF attachments with your shipping confirmation.

§7 – Retention of Title

Goods remain our property until full payment is received. Offsetting is only permitted with legally recognized claims. If the customer is in default of payment, all pending amounts become immediately due.

§8 – Right of Revocation

You may cancel your order within 14 days without giving a reason. To cancel, notify us via email or post:

Refunds are issued within 14 days of cancellation notice, using your original payment method. Goods must be returned within 14 days in unused condition. If the enclosed return label is not used, the return cost is your responsibility. Sale items are excluded from refund, but may qualify for store credit.

§9 – Warranty

We follow Swiss consumer law: warranty coverage is 1 year from delivery for material defects.

§10 – Data Protection

Personal data is handled according to our privacy policy and current Swiss legislation. You can view or download our privacy policy at any time from our website.

§11 – Liability

We are fully liable for damages caused by intentional or gross negligence. For minor negligence, liability is limited to foreseeable damages (except for injury to life, body, or health). Statutory liability, including product liability, remains unaffected.

§12 – Final Provisions

Swiss law applies exclusively. The place of jurisdiction is Fribourg, Switzerland. If any clause is found to be invalid, the remaining terms remain effective.
